The Supreme Court on Wednesday ruled that Section 125 Code of Criminal Procedure (CrPC) applied to all married women including Muslim married women and they can claim maintenance from their husbands under these provisions. Speaking to Mediapersons, on the verdict, Senior Advocate of Supreme Court Karuna Nundy said “There are a number of issues that have been clarified by the court. Sec. 125 of the CrPC, under which you can get maintenance against your husband, applies to Muslims, non-Muslims, and all married women.
सुप्रीम कोर्ट ने बुधवार को फैसला सुनाया कि दंड प्रक्रिया संहिता (सीआरपीसी) की धारा 125 सभी विवाहित महिलाओं पर लागू होती है, जिनमें मुस्लिम विवाहित महिलाएं इन प्रावधानों के तहत अपने पति से भरण-पोषण की मांग कर सकती हैं। फैसले पर मीडियाकर्मियों से बात करते हुए सुप्रीम कोर्ट की वरिष्ठ अधिवक्ता करुणा नंदी ने कहा, “अदालत ने कई मुद्दों को स्पष्ट कर दिया है। सीआरपीसी की धारा 125, जिसके तहत आप अपने पति से गुजारा भत्ता प्राप्त कर सकती हैं, इस पर भी लागू होती है। मुसलमान, गैर-मुसलमान और सभी विवाहित महिलाएं।
सुप्रीम कोर्ट ने एक मामले की सुनवाई करते हुए कहा है कि मुस्लिम महिलाएं भी तलाक के बाद पति से गुजारा भत्ता पाने की हकदार हैं। कोर्ट ने कहा कि मुस्लिम महिलाएं इसके लिए याचिका भी दायर कर सकती हैं।
The Supreme Court, while hearing a case, has said that Muslim women are also entitled to get alimony from their husbands after divorce. The court said that Muslim women can also file a petition for this.
